National (NMLS) · Federal & NationalNMLS Practice Test 2026: SAFE MLO Exam Questions
The SAFE Mortgage Loan Originator Test is the national exam that anyone seeking a state mortgage loan originator (MLO) license has to pass. It has 120 multiple-choice questions, a 190-minute time limit and a 75% passing standard. It covers federal mortgage law, uniform state content, general mortgage knowledge, loan origination activities and ethics.
ExamCleared is an independent study tool and is not affiliated with NMLS, CSBS, the CFPB or Prometric. Our bank has about 250 original practice questions written from the public statutes, regulations and NMLS materials. Every question comes with an explanation and a cited statute or official source, along with the date we last verified it. You can take a timed full-length exam in the same format as the official test (120 questions, 190 minutes) or try 10 questions for free without an account. Access is a one-time payment of $24.99 for 30 days or $39.99 for 90 days, with no subscription and a 7-day money-back guarantee. This practice test adds to the 20 hours of NMLS-approved pre-licensing education that licensing requires. It does not replace that education.

1. Under the Interagency Guidance on Nontraditional Mortgage Product Risks, how should an institution qualify a borrower for a payment-option ARM?
- At the introductory start rate using the minimum payment
- At the start rate using the interest-only payment amount
- Using the simple average of the minimum payment and the fully amortizing payment
- At the fully indexed rate using a fully amortizing repayment schedule, based on the loan amount plus any balance increase from negative amortization
Show answer
Answer: D. At the fully indexed rate using a fully amortizing repayment schedule, based on the loan amount plus any balance increase from negative amortization
The guidance calls for analyzing repayment at the fully indexed rate on a fully amortizing schedule. For products that allow negative amortization, the analysis should also include any balance increase that could build up.

2. Before issuing the Loan Estimate, an MLO asks the applicant to upload pay stubs, W-2s and bank statements "so we can prepare your Loan Estimate." Is this permitted?
- Yes, if the documents are needed so the creditor can price the loan accurately for the consumer
- No; the creditor may not require verification documents before providing the Loan Estimate
- Yes, as long as no fee is charged for reviewing them
- No, unless the applicant has already paid an application fee
Show answer
Answer: B. No; the creditor may not require verification documents before providing the Loan Estimate
The creditor may ask for information, but it may not require the consumer to submit documents verifying that information before the Loan Estimate is provided.

3. Dana's state MLO license lapsed on December 31, 2019. From January 2020 through December 2024, she worked as a registered loan originator at a bank. She left the bank in January 2025 and applies for a state license in November 2026. Must she retake the SAFE MLO Test?
- Yes, because she has gone almost 7 years in total without a state license
- No, because her bank years are excluded, so the lapse is under 5 years
- Yes, because any lapse longer than 1 year requires a new passing test
- No, because a passing SAFE MLO Test result never expires once earned
Show answer
Answer: B. No, because her bank years are excluded, so the lapse is under 5 years
A retest is required only after 5 or more years without a valid license, and time spent as a registered loan originator is not counted. Excluding 2020–2024, Dana has been unlicensed only from January 2025 to November 2026, about 1 year and 10 months.

4. Under the Customer Identification Program rule adopted under the USA PATRIOT Act for banks, when must the bank obtain the customer's name, date of birth, address and identification number?
- Prior to opening an account
- Within 30 days after opening an account
- Only if the transaction exceeds $10,000
- Only when filing a Suspicious Activity Report
Show answer
Answer: A. Prior to opening an account
The CIP must require the bank to obtain, at a minimum, name, date of birth (for individuals), address and an identification number from the customer before the account is opened, so the bank can form a reasonable belief it knows the customer's true identity.

5. A for-profit mortgage brokerage wants to call its loan officers 'mortgage counselors' in its advertisements for home loans. Under Regulation Z, this is:
- Prohibited in advertisements for credit secured by a dwelling
- Permitted if every loan officer holds a current state MLO license
- Permitted if the ad shows the brokerage's NMLS ID
- Prohibited only in television and radio advertising
Show answer
Answer: A. Prohibited in advertisements for credit secured by a dwelling
Regulation Z treats calling for-profit brokers, creditors or their loan staff 'counselors' as a misleading practice in dwelling-secured credit ads. The ban applies to all media, and licensing or an NMLS ID does not make it permissible.

What the SAFE MLO Test is and who takes it
The SAFE Mortgage Licensing Act of 2008 requires every mortgage loan originator to be either state-licensed or federally registered. To get a state license, you have to pass a written test developed by NMLS (the Nationwide Multistate Licensing System & Registry). The current version is the SAFE MLO National Test with Uniform State Content. It is a single national test, and it includes the state law material that used to be tested separately.
- Who needs it: anyone applying for a state MLO license (12 U.S.C. 5104).
- Who usually does not: employees of depository institutions who are federally registered MLOs. They are registered rather than state-licensed.
- Returning originators: if your state license has lapsed for 5 years or longer, you have to take the test again. Time you spent as a registered loan originator does not count toward those 5 years.
SAFE MLO exam format: questions, time limit and passing score
The official format below comes from the NMLS MLO Testing Handbook. It has been in effect since April 5, 2021.
- Questions: 120 multiple-choice items. 115 are scored and 5 are unscored pretest questions. The pretest questions are mixed in at random, so you will not know which ones they are.
- Time: 190 minutes of test time. The full appointment is 225 minutes, which includes a tutorial and an optional survey.
- Passing score: 75% or better, as the SAFE Act requires. NMLS does not publish a separate raw cut score.
- Closed book: you cannot bring books, papers (including scratch paper) or reference materials into the test room. The test center gives you a basic 4-function calculator and writing materials.
- Breaks: you may take unscheduled breaks, but the test clock keeps running.
Fees, registration and scheduling
- Create an individual NMLS account if you do not already have one.
- Create a test enrollment window in NMLS and pay for it. The fee is $110. Test centers do not accept payment, and the fee is non-refundable and non-transferable. You can pay it yourself, or any company with access to your NMLS record can pay it.
- Accept the Candidate Test Security and Confidentiality Agreement. You cannot schedule the test until you do.
- Schedule your appointment with Prometric. You can do this in NMLS, on the Prometric website or by phone at 1-877-671-6657. Once your enrollment is paid, you have 180 days to schedule and take the test.
The test is given only at Prometric test centers in the United States, Puerto Rico and the US Virgin Islands. Since October 1, 2024, online proctored testing has been available only to candidates who qualify for ADA testing accommodations. On test day, arrive 30 minutes early with a current government-issued photo ID that has your signature.
Prerequisites: pre-licensing education and licensing standards
The SAFE Act requires at least 20 hours of NMLS-approved pre-licensing education for state licensing. Those hours must include at least:
- 3 hours of federal law and regulations
- 3 hours of ethics, including fraud, consumer protection and fair lending
- 2 hours on lending standards for the nontraditional mortgage product marketplace
NMLS notes that the SAFE Act does not require you to finish your education before you schedule and take the test. However, you still need it to get licensed. Some states require additional hours, so check the NMLS Resource Center for your state's rules. Our practice test works alongside an approved course and does not replace it.
The minimum licensing standards also include fingerprints for a criminal background check and a credit report. You cannot have had an MLO license revoked. You also cannot have a felony conviction in the 7 years before you apply, or at any time if the felony involved fraud, dishonesty, breach of trust or money laundering.
What the NMLS exam covers: official content outline
NMLS publishes the SAFE MLO National Test with Uniform State Test Content Outline, which divides the test into five content areas:
- Federal Mortgage Related Laws (24%): RESPA/Regulation X, ECOA/Regulation B, TILA/Regulation Z including HOEPA, higher-priced mortgage loans, LO compensation and TRID, plus HMDA, FCRA/FACTA, Red Flags, BSA/AML, GLBA, the MAP advertising rule, E-Sign, the USA PATRIOT Act, the Homeowners Protection Act and the authority of the CFPB and HUD.
- Uniform State Content (11%): the SAFE Act and CSBS/AARMR Model State Law, including who must be licensed, licensee qualifications, renewal and continuing education, NMLS identifier and filing requirements, temporary authority, regulator powers, and prohibited and required conduct.
- General Mortgage Knowledge (20%): qualified and non-qualified mortgages, conventional and government loans (FHA, VA, USDA), nontraditional product guidance, loan products (ARMs, balloon, reverse, HELOC, construction, interest-only) and industry terms.
- Mortgage Loan Origination Activities (27%): the application process, verification, tolerances, Loan Estimate and Closing Disclosure timing, borrower qualification, appraisals, title, insurance, closing and financial calculations.
- Ethics (18%): prohibited acts, fair lending, fraud detection, advertising, predatory lending and steering, and ethical behavior with borrowers.
NMLS states that candidates are responsible for keeping up with changes to the applicable statutes, regulations and rules.
Study tips for SAFE MLO test questions
- Weight your time by the outline. Federal law and origination activities together make up just over half of the test (24% + 27%), so spend the most time on RESPA, TILA/TRID and ECOA.
- Learn timing rules from the regulation text. Many questions depend on a specific deadline or waiting period, such as the Loan Estimate and Closing Disclosure timing in Regulation Z or the adverse action notice in Regulation B. Pay attention to whether a rule counts business days or calendar days.
- Know who is exempt from what. State content questions often hinge on definitions, such as licensed versus registered MLOs, clerical or support duties versus loan origination, and what a loan processor may do.
- Practice the math without notes. You only get a 4-function calculator, so practice interest, monthly payment, LTV, DTI and ARM adjustment problems by hand.
- Read ethics scenarios carefully. These questions usually ask what an MLO should do. Look for the answer that follows the law and protects the borrower, not the one that only closes the loan.
- Simulate test day. Take at least one full mortgage loan originator practice test of 120 questions in 190 minutes. Then use the explanations and cited sources to review every question you missed.
Retakes and next steps after the test
If you fail, you must wait 30 calendar days after your previous test date before you can retake it. After every third failed attempt, you must wait 180 calendar days. Each attempt needs a new enrollment and fee. Once you pass, you are not allowed to retake the test.
Passing the test is only one step toward a license. Your state license also depends on the other standards in 12 U.S.C. 5104, including pre-licensing education, background checks, financial responsibility and any net worth, surety bond or state fund requirement. Check your state's requirements in NMLS before you apply.
