1. On a loan secured by a buyer's principal dwelling, the loan officer tells the appraiser that future assignments depend on the value coming in at or above the contract price. Under Regulation Z, this is:
- Prohibited, because implying that retention depends on the reported value is coercion
- Permitted, because the lender is the appraiser's client and may set the value it needs
- Permitted as long as the loan officer makes the request in writing and keeps a copy
- Prohibited only if the appraiser holds a state certified (rather than licensed) credential
Show answer
Answer: A. Prohibited, because implying that retention depends on the reported value is coercion
Valuation independence rules bar covered persons from influencing the value through coercion or inducement. Implying that the appraiser's future work depends on the value reported is listed as a violation.

2. A California licensed land surveyor's field survey finds a physical change that doesn't appear on any recorded subdivision map. What must the surveyor do?
- Nothing, because filing a record of survey is always optional
- File a record of the survey with the county surveyor
- Report the change only to the Bureau of Land Management
- Personally correct the recorded subdivision map
Show answer
Answer: B. File a record of the survey with the county surveyor
Filing a record of survey is optional in general. It becomes mandatory when the survey discloses material evidence or a physical change that doesn't appear on any recorded map.

4. A grantor deeds land to a church 'on condition that' it be used only for worship, keeping a right of reentry if the condition is broken. Years later the church leases the land as a commercial parking lot. What interest lets the grantor end the church's estate?
- A vested remainder in the grantor's heirs
- A power of termination (right of reentry)
- An easement in gross held by the grantor
- A reversion following a life estate in the church
Show answer
Answer: B. A power of termination (right of reentry)
The church holds a fee simple subject to a condition subsequent. When the condition is broken, the estate doesn't end automatically; the grantor must act on a power of termination (right of reentry) to take the land back.

- A natural wetland protected from filling under Section 404 of the Clean Water Act
Show answer

What the NYS real estate salesperson exam is and who takes it
The state salesperson exam is the written test you must pass, along with the 77-hour qualifying course, before you can apply for a New York real estate salesperson license. The Department of State gives the exam itself at its own exam sites. There is no third-party testing company.
You take it if you want to work as a real estate salesperson in New York. A salesperson must be sponsored by a New York licensed real estate broker and cannot operate independently. Official details are on the DOS Real Estate Salesperson page.
New York real estate exam format: questions, time and passing score
- Question type: multiple choice, based on the 77-hour pre-licensing curriculum.
- Time: 1 1/2 hours (90 minutes). The clock starts after the instructions are finished.
- Number of questions: DOS does not publish it. You may see a count on prep websites, but we could not confirm it from an official source, so we don't repeat it here.
- Passing score: DOS does not publish one. Results are reported as passed or failed, and you do not get a numerical score.
- Where: in person at a DOS exam site in Albany, Binghamton, Buffalo, Franklin Square, Hauppauge, New York City, Plattsburgh, Pomona, Rochester, Syracuse or Utica. DOS says no one is admitted after the starting time.
- Open or closed book: the DOS pages we checked don't say what materials are allowed. It is a proctored exam, so plan to test without notes, and read the exam policies you accept in eAccessNY.
Our timed full-length mode uses the same 90-minute, multiple-choice format, which helps you practice pacing.

Study tips for NY real estate salesperson exam questions
- Learn New York rules, not just general principles. Agency disclosure under Real Property Law §443, license law in RPL Article 12-A, and the protected classes in Executive Law §296 go further than many national textbooks.
- Read the DOS Real Estate License Law pamphlet. It collects the statutes and regulations licensees work under, such as rules on escrow, advertising and disclosure of interest.
- Watch the wording. Many questions depend on who the agent represents (seller, buyer, landlord, tenant or dual agent), so find that first.
- Don't skip the smaller topics. Commercial and investment property, condos and co-ops, and land use make up a large share of the course hours.
- Practice under time. Take at least one full 90-minute timed exam so you know your pace before test day.
- Read the explanations, including for questions you got right. Then check the cited source when something surprises you.
You can try 10 free questions without an account. Full access is a one-time payment, not a subscription: $24.99 for 30 days or $34.99 for 60 days. Both come with a 7-day money-back guarantee.
After you pass: getting your salesperson license
- Check your result in eAccessNY under "View Exam Results". "Waiting for Score" means the result hasn't been processed yet.
- A passing result is valid for two years, so apply within that time.
- File the salesperson application online through eAccessNY and pay the $65 initial application fee.
- Your principal broker must log on to their own account and authorize your application.
- DOS reviews the application and, once it is approved, mails the license to your business address.
